- Co-counsel in five major commercial trials during the 1990’s on behalf of Mark VII. Ten years management of over 300 commercial cases for Mark VII, involving more than $6 million of fees to outside counsel. No major uninsured losses were incurred.
- 20 years of heavy involvement in risk management of insurance coverage and related business risk.
- Kansas Supreme Court certified mediator, 1996 to present.
- Co-counsel in 5 major arbitration proceedings and 15 major formal mediations.
SURFACE TRANSPORTATION, WAREHOUSING, LOGISTICS AND MANAGEMENT.
- Admitted to practice before the Interstate Commerce Commission in 1961.
- Prepared and prosecuted numerous applications for certificates of public convenience and necessity on behalf of Graves Truck Line Inc. from 1962 through 1975
- Continuous participation in the administration and litigation of cargo loss and damage claims involving surface transportation carriers from 1961 to present.
- Primary legal responsibility for motor carrier driver and equipment qualification and compliance with the safety rules and regulations of the Federal Bureau of Motor Carrier Safety and the various State agencies for Graves Truck Line 1966-1980, Missouri-Nebraska Express 1991 through 1996 and Mark VII Transportation Co., Inc. 1993 to present.
- Identified and outlined the legal framework for Mark VII’s initial management project on behalf of the Whirlpool Corporation finished goods in 1989. Provided the same service with respect to Mark VII’s supply service of fresh potatoes to 23 Frito-Lay potato chip plants in 1993.
- Formulation and drafting of more than 150 transportation service agreements involving shippers, carriers, brokers and warehousemen to facilitate various elements of logistics and management projects.
- In-depth experience in the negotiation and drafting of debt and lease financing of transportation equipment.
REAL ESTATE.
- Approved Kansas title attorney for Chicago Title Insurance Company, 1983-1991.
- Managed the land acquisition, construction, and contracting for 20 motor carrier freight terminals at Graves Truck Line.
- Mediated re-acquisition by Atlantic Richfield of 52 acres of contaminated industrial property in Kansas City.
- Developed and zoned a 160 acre residential real-estate development at Salina, Kansas.
- Served as legal adviser to a number of condominium and homeowners associations in both Kansas and Missouri.
- Formed and contracted for street developments in two special benefit districts in Andrew County, Missouri.
BANKRUPTCY COURT PRACTICE.
- As litigation counsel to seven banks and two savings and loan associations during the 1980’s liquidation of collateral on defaulted loans often caused the debtors to resort to the jurisdiction of the Bankruptcy Courts. Served as counsel to the secured creditors in such proceedings.
EMPLOYMENT LAW.
- Managed grievances, collective bargaining negotiation and litigation with the International Brotherhood of Teamsters on behalf of Graves Truck Line, Inc. from 1961 to 1980.
- Administered and provided legal compliance with respect to large fleets of owner/operator truckers at both Graves Truck Line and Missouri Nebraska Express.
- Participated in defense of EEOC discrimination charges involving age and sex.
- Provided legal oversight for the overall human resources management function for the following companies:
